Health and safety counts

Bournemouth Crown Court has sentenced Marks and Spencer plc (M&S) and two of its contractors for health and safety offences relating to asbestos removal in the refurbishment of two of its stores. The three companies breached their duty to protect the health and safety of their staff and their duty to members of the public and other workers.
This checklist sets out the potential implications for a business that a conviction for a breach of health and safety legislation can have on its operations.

The fines

The court fined:

M&S £1 million and ordered it to pay costs of £600,000.

Styles & Wood Ltd £100,000 and ordered it to pay costs of £40,000.

Willmott Dixon Construction Ltd £50,000 and ordered it to pay costs of £75,000.
